Criminal Injury Compensation

If you have been a recent victim of a crime, then there is a very good chance that you'll be entitled to make a criminal injury compensation claim.

Violent crime is unfortunately a fact of life. We do whatever we can to avoid it, but although rare, there are thousands of victims each year. In any violent crime, your priority is of course, reporting the matter to the police and seeking medical attention for yourself.

Who May File for a criminal injury compensation Claim? A person who suffers physical injury as a result of a crime. Criminal injury compensation is money paid to people who have been physically or mentally injured because they were the innocent victim of a violent crime. Payments made for criminal injury compensation are intended to defray the costs of medical services, loss of earnings, burial costs, and other financial losses incurred as a direct result of personal injuries sustained by a criminal offense.

In the UK there is a Government funded body called the CICA Criminal Injuries Compensation Authority that has been set up specifically to deal with claims of this nature. In the US the Criminal Injuries Compensation Fund provides financial assistance to crime victims through two programs. Look for a government body or company that provides criminal injury compensation in your area.

If you have grounds to believe that you have a criminal injury compensation claim, you can obtain a compensation form from a personal injury solicitor, which you then need to compete and return. If you plan to make a claim to the CICA for criminal injury compensation, then you'll need to show that you have suffered either physical or mental harm as a result of having been the victim of the violent crime in question.

In each case, good legal representation can mean a compensation claim that eases the physical and mental recovery process, whether your attacker is found and charged or not.

Unlike most injury claims where both sides argue over how much an injury is 'worth', as a government appointed, public funded organization the Criminal Injury Board sets the rules and is pretty black and white. They will only pay compensation to victims of crime, and only when that victim has been either physically or mentally injured as a result of that crime.

Eligible crimes generally include, but are not limited to, homicide, aggravated assault, sexual assault, robbery by force, and drunk driving. To make a claim you must have reported the assault to the police as soon as possible. In cases of homicide, the Board may assist with funeral expenses and loss of support on the part of the victim's dependents. To make a criminal injury compensation claim, you must have reported the assault to the police as soon as possible.
